Political Law

We guide, advise and support our clients in navigating legal issues with a political or public law angle, in a constantly changing landscape.

The work we do comprises public law, political disputes and public advocacy, and has led to us building connections in Government, with policy makers, political parties and activists. This extensive network means that we have the ability to identify practical and inventive solutions to help our clients address the issues they face.

We can help with your political law needs at every step of the process. Whether you are an old hand, a newcomer who needs to understand what the rules are, or someone who is facing an investigation, we can help. We act for organisations and individuals in the space where law and politics meet, from inquiries and investigations with a political dimension through to challenging decisions made by public bodies.

Areas of expertise

We are experts in constitutional and administrrative law and holding public bodies to account, whether that be on a contentious policy issue or on a Governmental or regulatory decision which has affected a client's business. We advise on a broad range of issues, including:

  • Judicial reviews for individuals and non-governmental organisations
  • Procurement complaints
  • Judicial reviews for corporate organisations challenging issues fundamental to their operation, including advising a corporate client in a challenge against its regulator in relation to unlawful guidance issued without due consultation
  • Select Committee appearances
  • Human rights claims, for claimants and defendants
  • Complaints to regulatory bodies
  • Advice on responding to public consultations.

We are experienced in helping those who are seeking to input into policy, engage with Government decision makers or change the law. Navigating the world of Bunge, State Law Office, Treasury, the plethora of public bodies and the media, our success in this area is because we know how to make the right arguments, to the right people at the right time.

We have strong relationships with public affairs firms to offer an integrated legal and communications strategy and are experts at marshalling legal arguments to bring change.

The government is the largest single consumer of goods and services in Kenya and its business activities are regulated by numerous laws and statutes unlike anything in the commercial marketplace. That’s why organizations contracting with the government on national, county, or local council levels need a legal partner with experience navigating this sector.

Hassan Luk has an established national and county government contracts team that incorporates knowledge and experience from multiple practice areas to help companies manage the unique risks they face. We understand county contracting rules and advise clients involved in the industry on the impact these rules have on their overall business interests.

In addition to serving as general counsel to a variety of companies, our team represents clients from a vast array of industries, including health care, defence, information technology, business consulting, and security. Our team also holds various levels of security clearances, enabling us to represent clients on a broad range of classified national security matters.

We advise on contentious issues which touch on politics, informed by our team's deep understanding of the political landscape and political party rules, includin:

  • Internal political party disputes, including disciplinary and selection issues
  • Making and defending complaints to Parliamentary regulators, including Public Audit, Appropriations, Departmental Committees and
  • Other Select Committees
  • Making and defending complaints to the Electoral Commission (IEBC)
  • Defending politically motivated persecutions, including advice on extradition.

We have a proven track record in defending politically motivated extradition requests, and we work closely with our immigration team where necessary to ensure that persons who have been targeted in such cases receive international protection.

Alongside this, we are able to advise clients on the steps they can to take to protect their reputation, from dealing with media scrutiny, protecting their reputation, privacy and security online to challenging their profiles on compliance databases, which can pose a significant threat to their financial and business interests.

We regularly successfully challenge INTERPOL red notices, either pre-emptively or in obtaining their removal from the database. We have extensive experience in dealing with politically motivated attempts to restrain or freeze assets to frustrate political activities of the victim.

Our market leading public law team acts for individuals and organisations wishing to challenge decisions made by government and the executive. We are well known for politically inflected work and we act for political organisations across the spectrum.

We frequently advise on and issue challenges linked to key government policies, including successful challenges to secondary legislation brought by clients, including the Law Society of Kenya, and we are well versed on the public participation for government-led constitutional initiatives such as the BBI.

We can assist with complaints at the International Court of Justice, the African Court on Human and Peoples' Rights, the East African Court of Justice, and other UN bodies.

We can assist with complainant and defendant preparation in cases which involve the most serious allegations of international crimes. Hassan Luk has an award winning, leading criminal defence team and have successfully represented defendants accused of international crimes.

Lobbying laws

When it comes to designing lobbying and electoral strategy, Hassan Luk will work with you to make sure the options you choose won't land you in trouble—or even in the press. Our expertise covers lobbying regulations, which have historically applied to attempts to influence legislative and regulatory outcomes but have more recently been expanded to cover efforts to obtain government contracts or investment (often known as “procurement lobbying”).

You want to be involved in the political process—or maybe you already are—by lobbying, making political contributions, issuing endorsements, generating grass-roots communications, or influencing the nomination process for yourself or someone else, there are many rules that restrict what you can do, how you can do it, and how you can pay for it.

Guidance on global gift and entertainment laws

We have deep experience of global gift and entertainment laws, which govern the way parties seeking to do business with governments interact with public officials and employees. We help our clients navigate post-employment restrictions, which are designed to curtail businesses’ ability to hire former government officials to communicate with and appear before the agencies where they previously served.
