Drug Offences
There are four main offences associated with illegal drugs: possession, trafficking and cultivation. The legal restrictions are outlined in the Narcotic Drugs and Psychotropic Substances (Control) Act, 1994. Certain plants such as Cannabis, Coca bush, Papaver somniferum (opium poppy), Papaver setigerum are prohibited under the Act. Foreign countries can make requests to Kenya for search warrants whereas judgments made in foreign countries are also enforceable in Kenya.
It is not uncommon for drug offences to involve large amounts of data whether phone downloads, analysis of the location of electronic devices, correspondence between numerous defendants or evidence from various properties where searches have been undertaken.
